Indemnity

Usage

The user acknowledges that the use of the website by the user does not constitute a joint venture, partnership, employment, or agency relationship between the user and Comfort Fincap Ltd. You agree not to hold yourself as a representative, agent, or employee of Comfort Fincap Ltd. shall not be liable for any representation, act, or omission of the user.

Legal Jurisdiction

The courts in Mumbai alone will have exclusive jurisdiction in relation to all disputes which may arise out of or in connection with the use of the website. The interpretation of these terms and conditions shall be construed in accordance with and governed by the laws of Union of India without giving effect to conflict of laws provision.

Terms and Conditions for Making Advance Payment

1. If there is no outstanding amount in your loan account. You are not required to make any payment. But, if you choose to make advance payment, which will be adjusted in future EMI. Please take note of the below before making any advance payment:

2. Illustration: EMI Due Date 02.01.2025

• Scenario 1: If advance payment is made on or before 01.01.2025, then the next EMI falling due on 02.01.2025 shall not be presented for payment. The advance payment shall be adjusted against the upcoming EMI.
• Scenario 2: If an advance payment is made on 02.01.2025, the upcoming EMI will still be deducted from your registered bank account on the next due date, i.e., 02.01.2025. Comfort Fincap Ltd. shall not be liable or responsible for any charges levied by your bank due to dishonour of the EMI. However, the advance amount received will be adjusted against your future EMIs or any bounced EMI.
• If there are Outstanding Dues: If there are outstanding dues in your account, then any payment made through this link shall be adjusted against such outstanding dues first. Any amount paid in excess of the outstanding dues shall be adjusted against the upcoming EMI by applying the same logic as illustrated in the aforesaid scenarios.

Payment Gateway Terms and Conditions Disclaimer

1. This Service is being provided to facilitate access to Customers (“Customers”) of Comfort Fincap Ltd. to pay their dues under their loan accounts online to Comfort Fincap Ltd. through an electronic and automated collection and remittance service hosted through the Payment Service Provider. Comfort Fincap Ltd. makes no representation of any kind, express or implied, as to the operation of the payment gateway other than what is specified for this purpose. The Customer expressly agrees that his/ her use of the aforesaid online payment Service is entirely at his/her/their own risk and responsibility of the Customer.

2. LIMITATION OF LIABILITY

• Comfort Fincap Ltd., its affiliates or employees shall in no way be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data or any other intangible losses arising out of or in connection with the access to or usage of the services of the Payment Service Provider.
• Comfort Fincap Ltd. assumes no liability whatsoever for any monetary or other damage suffered by you on account of any delay, failure, interruption, or corruption of any data or other information transmitted or any interruption or errors in connection with the use and operation of the Payment Service Provider.
• You shall indemnify and hold harmless Comfort Fincap Ltd. and their respective officers, directors and employees, from any claim or demand, or actions. Comfort Fincap Ltd. will not be liable for any failures in the external link or for any fraud perpetrated either at the Payment Service Provider's and/or at the bank's end that matters could take place during or after the time of you making payment.
• You agree, understand and confirm that any personal data including details related to debit card or bank accounts submitted by you during the time of making payment is transmitted over the Internet and is susceptible to misuse, theft and/or fraud and that Comfort Fincap Ltd. has no control over such.
• Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by you, Comfort Fincap Ltd. does not in any way guarantee that the use of the payment gateway will not result in theft and/or unauthorized use of data over the Internet.

3. DEBIT CARD, BANK Account and UPI DETAILS

You may pay your dues under your loan to Comfort Fincap Ltd. by using a Debit Card, UPI or through your Internet Banking Account. You submit and agree that the Debit card details provided by you to the Payment Service Provider for payment transaction processing will be correct and you shall not use a debit card UPI and Bank account detail, which is not lawfully owned by you. You agree that when you initiate a payment transaction and/or issue an online payment Instruction and provide your Debit or Bank account details:

• You warrant that you are fully and lawfully entitled to use the said Debit Card, UPI or Bank Account for such transactions.
• You are responsible for ensuring that all the Debit Card, UPI or Bank Account details provided by you are accurate.
• You are authorising the debit to the nominated Debit Card, UPI or Bank account for the settlement of bills selected by you along with the applicable fees.
• You are responsible for ensuring that sufficient balance is available on your presented Debit Card , UPI or Bank Account at the time of making the payment to permit the payment of the dues selected by you inclusive of the applicable fees.

Terms & Conditions applicable for SMS Communication

1. Loan at the sole discretion of Comfort Fincap Ltd.
2. Processing fees and other applicable charges shall be payable.
3. Comfort Fincap Ltd. may engage services of agents in sales/ marketing etc. for onboarding of customers.
4. Please read the loan documents for detailed terms and conditions.
